Your rights under Hawaii law

You can stop the tow for free.If you return while your car is being hooked up â up to the moment the truck drives away â the company must release it to you at no charge.

Release is 24/7 on Oâahu.Because Honolulu has over 500,000 residents, the tow company must offer service and release your vehicle 24 hours a day, every day. There is no lawful âcome back tomorrow.â

They must take a card.The company must accept cash, credit card, and debit card. They cannot force you to an on-site ATM.

Those fees are the maximum.The charges listed here are the only charges allowed by law. Anything else is a violation.

Written notice within 15 days.The company must mail the registered owner (certified/registered mail) the vehicleâs location within 15 days. If they donât, you may recover your vehicle without paying tow or storage fees.

30-day window.If the vehicle isnât claimed within 30 days after that notice is mailed, it may be treated as abandoned and sold.

These are the maximum charges allowed under HRS §290-11(b)(1). They are the only charges a company may bill you.
